Terms of Service

Welcome to Landys. These Terms of Service ("Terms") govern your use of the Landys mobile application ("App", "Service") operated by Vladislav Danshov ("we", "us", "our").

By creating an account or using Landys, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. What Landys Is

Landys is a personal organizational tool designed to help independent landlords manage their properties, guests, and bookings. The App allows you to record, store, and organize rental-related information for your own convenience.

What Landys Is Not

Landys is not a legal, financial, tax, or accounting tool. The App does not:

• Constitute or replace professional legal, financial, or tax advice.
• Generate legally binding rental agreements or contracts.
• Verify the accuracy, legality, or completeness of any information you enter.
• Guarantee compliance with any local, regional, or national rental regulations.
• Process payments or act as a payment intermediary between you and your guests.

You are solely responsible for ensuring that your rental activities comply with all applicable laws and regulations in your jurisdiction. We strongly recommend consulting qualified legal and financial professionals for matters related to property rental.

2. Eligibility

You must be at least 16 years old to use Landys. By using the App, you represent that you meet this age requirement.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate information when creating your account.
• Notify us promptly if you become aware of any unauthorized access to your account.
• Not share your account credentials with others.

We are not liable for any loss or damage arising from unauthorized use of your account.

4. Your Content

4.1 Ownership

You retain full ownership of all data and content you enter into Landys, including property details, guest records, booking information, and photos ("Your Content"). We do not claim any ownership rights over Your Content.

4.2 License to Us

By using the App, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you. We will not use Your Content for any other purpose.

4.3 Your Responsibilities

You are solely responsible for the accuracy, legality, and appropriateness of Your Content. You agree not to use Landys to store or transmit any content that:

• Violates any applicable law or regulation.
• Infringes upon the rights of any third party.
• Contains malicious software or harmful code.

4.4 Guest Data

Landys allows you to store personal information about your guests (such as names and phone numbers). By entering guest data into Landys, you acknowledge that:

• You act as the data controller of your guests' personal information under applicable data protection laws.
• You are responsible for having a lawful basis to collect, store, and process your guests' personal data.
• You are responsible for informing your guests about how their data is stored and used, as required by applicable law.
• We act solely as a data processor, storing guest data on your behalf to provide the Service.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Reverse engineer, decompile, or disassemble the App.
• Use automated tools, bots, or scrapers to access the App.
• Interfere with or disrupt the integrity or performance of the Service.
• Resell, sublicense, or redistribute the App or any part of it.

6. Service Availability and Changes

We strive to keep Landys available and functional, but we do not guarantee uninterrupted or error-free operation. We reserve the right to:

• Modify, update, or discontinue any feature of the App at any time.
• Perform maintenance that may temporarily affect availability.
• Introduce paid features or subscription plans in the future, with reasonable advance notice. Any existing free functionality at the time of such changes will be communicated clearly.

7. Account Suspension and Termination

7.1 By You

You may delete your account at any time through the App (Profile → Settings → Delete Account) or by contacting us. Upon deletion, all Your Content will be permanently removed from our servers within 30 days.

7.2 By Us

We may suspend or terminate your account if:

• You violate these Terms or our Privacy Policy.
• Your use of the App poses a security risk or may cause harm to other users or our systems.
• We are required to do so by law.

Where possible, we will provide notice before taking such action and give you an opportunity to export Your Content. In cases of serious or urgent violations, we may act immediately without prior notice.

8. Disclaimer of Warranties

The App is provided on an "as-is" and "as-available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Without limiting the foregoing, we do not warrant that:

• The App will meet your specific requirements.
• The App will be uninterrupted, timely, secure, or error-free.
• Any data stored in the App will be accurate, reliable, or preserved without loss.
• Any errors or defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities.
• Loss of data or content.
• Loss of bookings, rental income, or guest relationships.
• Any damages arising from reliance on information stored in the App.

Our total aggregate liability to you for any claims arising from or related to the use of the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or €50 (fifty euros), whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

10. Data and Backups

While we take reasonable measures to protect Your Content, you are solely responsible for maintaining your own backups of any important data you store in Landys. We are not liable for any data loss, regardless of cause.

11. Intellectual Property

The Landys App, its design, logo, code, and all related materials are our property or the property of our licensors and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, branding, or proprietary technology beyond the right to use the App as described herein.

12. Third-Party Services

Landys uses third-party services (such as cloud hosting) to provide the App. We are not responsible for the practices or availability of any third-party services. Your use of the App is also subject to any applicable terms of the platform through which you downloaded it (Apple App Store or Google Play Store).

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Russian Federation. Any disputes arising from or relating to these Terms or the use of the App shall be subject to the jurisdiction of the courts of the Russian Federation at the defendant's location, unless otherwise required by applicable law.

If you reside outside the Russian Federation, you retain the benefit of any mandatory provisions of the law of the country in which you reside.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email at least 14 days before the changes take effect. Your continued use of Landys after the changes take effect constitutes acceptance of the updated Terms.

If you do not agree with the updated Terms, you may delete your account before they take effect.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
